Cases of those who were granted or not granted permission

In order to obtain the permission of status of residence of "Business Manager", an applicant needs to prove that the facilities to be used as the office for the business are located in Japan.

Ministry of Justice published the "Clarification of the standards of the status of residence for "Business Manager" in August, 2005. It states the cases where the adequate condition was recognized and permission was granted, and where permission was not granted.

Cases - Permission was Granted

  • 1
    Type of Business: Restaurant (Sole Proprietorship)
    Type of Procedure: Change of Status of Residence
    Overview: The purpose of use in a lease contract of a rental property was "Residence"; however, the applicant had entered into a special contract with lessor to use the rental space as "Office".

    Type of Business: Import and Export of Sea Food & Processing and Selling of Sea Food (Private Company)
    Type of Procedure: Certificate of Eligibility
    Overview: Company’s head office was located in the house of the officer; however, the applicant had also made a rental agreement for its branch office in a space of the Chamber of Commerce and Industry.

    Type of Procedure: Certificate of Eligibility
    Overview: Entrances of the house and the office were separately placed in the "home-cum-office", and there was a nameplate of the company on the entrance. Moreover, a computer, a telephone and Xerox were appropriately set up inside the office.

Cases - Permission was not Granted

    Type of Procedure: Extension of Period of Stay
    Overview: There was not any nameplate of the company on entrance and mailbox of the "home-cum-office", and the office did not seem to be undertaking any business activity.  Moreover, the payroll and attendance books had not been kept in the office.

    Type of Procedure: Certificate of Eligibility
    Overview: There was not any nameplate of the company on entrance and mailbox of the "home-cum-office", and the office did not seem to be undertaking any business activity.

    Type of Business: Design Company (Limited Company)
    Type of Procedure: Change of Status of Residence
    Overview: The lessee of the rental property and the payer of the utility expenses for the office were an employee of the company, and the employee was living in the same property; moreover, the applicant had not entered into any special contract with lessor to use the rental space as "Office".
Point
  • If an applicant establishes his/her office in "home-cum-office", he/she should obtain permission from a lessor in advance to use the rental space as "Office".

  • If an applicant forms a "home-cum-office", nameplates of the company should be clearly attached on the entrance and mailbox of the "home-cum-office".

  • If an applicant forms a "home-cum-office", the space of residence and office should be partitioned and set up office equipment inside. Moreover, the burden of expenses relating to the public utility charges should be clearly concluded in advance.
