Hiring Domestic Servant (Two Types)

There are two methods for a highly skilled professional to hire a domestic servant in Japan. Each method has some differences in terms of the requirements; therefore, a foreigner should hire a domestic servant after considering these differences carefully.

Bringing a Current Servant to Japan

A servant enters Japan with a highly skilled professional.
  • The servant is required to enter Japan and expected to leave Japan with the highly skilled professional.
  • The relevant domestic servant has been employed by the highly skilled professional for at least one year prior to entering Japan.
  • The servant is unable to change his/her employer after entering Japan.
  • In this case, both the highly skilled professional and domestic servant need to apply for the "Certificate of Eligibility" for entry into Japan.

Hiring a Servant in Japan

A highly skilled professional employs a servant in Japan.
  • The servant is not required to enter Japan and expected to leave Japan with the highly skilled professional.
  • The highly skilled professional is not required to have a working record (for at least one year prior to entering Japan) of the relevant domestic servant.
  • The domestic servant is able to change his/her employer in Japan.
  • In this method, the highly skilled professional is ONLY permitted to hire the domestic servant if there are certain family circumstances WHEN the domestic servant enters Japan.

(※) Family Circumstances: The highly skilled professional has a child under 13 years of age, or the spouse of the highly skilled professional is unable to carry out  normal daily housework due to illness or for other reasons.

  • The highly skilled professional can hire the foreign domestic servant in Japan, or call the domestic servant who is currently residing in a foreign country. If the highly skilled professional is accompanying the domestic servant to Japan, who does not meet the conditions (i.e., working record prior to entry into Japan), the foreign professional is able to hire the domestic servant by this method.
  • If the highly skilled professional is hiring the foreign domestic servant (or the foreigner with other working visa) who is currently residing in Japan, the domestic servant (or the foreigner) is required to apply for permission for change of status of residence because of a change of the employer.
  • If the highly skilled professional is calling the domestic servant from a foreign country or accompanying the domestic servant to Japan, the domestic servant is required to obtain the "Certificate of Eligibility" for entry into Japan.

Common Requirements

  • The highly skilled professional's household annual salary (Aggregation of the annual salary of the foreign professional and his/her spouse) is at least 10 million yen.
    • The salary of his/her parents or other cohabitants cannot be included in the calculation of the household annual salary.
    • If the household annual salary drops below 10 million yen at the time of filing the domestic servant's application for permission for extension of period of stay, the domestic servant's period of stay cannot be extended
  • The highly skilled professional may hire only one domestic servant.
  • The highly skilled professional pays the domestic servant at least 200,000 yen per month.
  • The status of residence for the domestic servant is the "Designated Activities" with a period of stay of one year.
  • This preferential immigration treatment is given to the highly skilled professional; therefore, if the employer loses the status of the highly skilled professional, the domestic servant will no longer be permitted to stay in Japan. 
    However, if the foreigner is then able to change his/her status of residence to the "Business Manager" or "Legal/Accounting Services" status, the foreigner may be permitted to continuously hire the domestic servant in Japan.
