Working Visa - Dispatched Workers

Scope of Working Visa

  • The type of working visa for foreign dispatched workers is generally the "Engineer/Specialist in Humanities/International Services".
  • Both types of visa are granted only if foreigners engage in activities/services based on a contract with a public or private organization in Japan.
  • The contract includes a "Worker Dispatch Contract".
  • Activities based on a "worker dispatch contract" are expected to be implemented stably and continuously.

Type of Dispatched Workers

  • General Workers:There is an employment relationship between a worker and a dispatching agency subject to the existence of a client company.
  • Specified Workers:There is an employment relationship between a worker and a dispatching agency regardless of the existence of a client company.

Type of Workers Designated for Working Visa

  • In general, the "Engineer/Specialist in Humanities/International Services" is granted for the "Specified Workers" for the following reasons.
  1. The "Specified Workers" are regularly employed by dispatching agency.
  2. The period of worker dispatching is generally longer for the "Specified Workers", and the required skill levels are usually higher for the "Specified Workers". (Example of job category of specified workers: Engineer)
  3. The applicant must still satisfy the permissible standards applicable for an intended working visa. (For example, the applicant must have graduated from a university majoring in a course related to intended activities in a client company, etc.) The "Specified Workers" are usually easy to satisfy these conditions.
  4. From the above reasons, the work activities of the "Specified Workers" are generally considered to be more stable and continuous

Notes

  • All terms and conditions must be agreed with a client when applying.
  • There is the possibility that a working visa is granted for "General Workers"; however, there are usually some difficulties to obtain the visa in terms of "stability" and "continuity".
